<br />' seasonal, but must be of sufficient extent and duration to normally reoccur annually. <br />Tributary wetlands do not include constructed or created wetlands. <br />' (30) "USE ATTAINABILITY ANALYSIS" means an assessment of the factors affecting the <br />attainment of aquatic life uses or other beneficial uses, which may include physical, <br />chemical, biological, and economic factors. <br />1 (31) "USES" see Beneficial Uses. <br />' (32) "WARM WATER BIOTA" means aquatic life normally found in waters where the summer <br />temperature frequently exceeds 20o C. <br />' (33) "WATER QUALITY-BASED DESIGNATION" means a designation adopted by the <br />Commission for specific state surface waters pursuant to section 31.8(2), to identify <br />which level of water quality protection such waters will receive under the Antidegradation <br />' Rule in section 31.8{1). Such designations are adopted pursuant to the Commission's <br />authority to classify state waters, as set forth in section 25-8-203, C.R.S., and the <br />procedural requirements for classifying state waters shall be applied in adopting such <br />designations. <br />(34) "WATER EFFECT RATIO" means a ratio that is computed as a specific pollutant's acute <br />or chronic toxicity value measured in water from the site covered by a standard, divided <br />' by the respective acute or chronic toxicity value in laboratory dilution water, as more <br />specifically defined in 40 C.F.R. subsection 131.36(c) (1993). <br />' (35) "WATER QUALITY STANDARD" see Standard. <br />(36) "WETLANDS" means those areas that are inundated or saturated by surface or ground <br />water at a frequency and duration sufficient to support, and that under normal <br />circumstances do support, a prevalence of vegetation typically adapted for life in <br />saturated soil conditions. <br />' 31.6 PROCESS FOR ASSIGNING CLASSIFICATIONS <br />The Commission is responsible for classifying state waters as set forth in sections <br />25-8-202(1)(a), and 25-8-203, C.R.S. All state surface waters may be classified in one or more <br />of the use classifications as set forth in section 31.13. <br />Waters shall be classified for the present beneficial uses of the water, or the beneficial uses that <br />may be reasonably expected in the future for which the water is suitable in its present condition <br />or the beneficial uses for which it is to become suitable as a goal. The assignment of one or <br />' more classifications to a portion of the state surface waters is based upon its current suitability <br />for the designated uses or goals for future uses. Where the use classification is based upon a <br />future use for which the waters are to become suitable, the numeric standards assigned to such <br />waters to protect the use classification may require a temporary modification to the underlying <br />numeric standard and an implementation plan for eliminating the temporary modification. <br />' When assigning classifications to waters of a given area, the Commission will consider the <br />goals, objectives, and requirements of federal and state statutes and regulations, <br /> <br />1 <br />
