Compliance with Terms and Conditions of Previous Permit <br />In April, 1987, [he permittee was issued an enforcement order for <br />violations of the TSS and T. Iron limits at 003 and 004. The <br />permittee explained the problem as inadequate treatment, especially <br />with the sediment load from the coal preparation plant. The problem <br />was addressed by stopping discharge of the preparation plant water <br />(see Section IV.A, above) and increasing the retention time in pond Ii5 <br />by use of baffles. The situation has not recurred at these points. <br />The data summary, above, shows a potential violation for TSS at <br />discharge point 001 in the third quarter of 1989. However, the <br />Division's files do not include any followup on this exceedance. <br />Since the problem has not recurred, no action is warranted at this time. <br />A site inspection in 1990 revealed a potential problem with chemical <br />storage. See Section VI.C.1 for a discussion of this issue. <br />VI. TERMS AND CONDITIONS OF PERMIT <br />A. Effluent Limitations <br />In developing suitable effluent limitations, the Division must review <br />all applicable standards and regulations and apply that which is more <br />stringent. This review includes, but is not limited to, the water <br />quality standard based effluent limitations, federal guidelines and <br />standards (40 CFR Subchapter N) and State Effluent Regulations <br />(10.1.0). Such a review has been done for this facility.
