The certifications were prepared incompliance <br />with Rules 4.05.6 (13) and 4.05.9 (] 0) of the Regulations of the Colorado Mined Land Reclamation <br />Boazd for Coal Mining and were certified by a registered Professional Engineer. The State Engineers <br />Office (SEO) did not conduct an inspection of the Fresh Water No.l Pond in 2001. However, the SEO <br />conducted an inspection on September 13, 2000. In the inspection report, MCC was required to <br />continue monitoring of movements in conjunction with the slide, repair damaged concrete on the <br />spillway weir, and backfill a hole at the toe the embankment 30' west of the valve vault. MCC <br />completed the maintenance items in compliance with the SEO recommendations on Fresh Water Pond <br />No.l, in October 2000. MCC continued to monitor the slide activity in 2001, referencing the <br />Appendix J, 2001 Addendum to Mountain Coal Company, LLC, West Elk Mine, 1997/98 Landslide <br />Corrective Measures Report. <br />Please notify me if you have questions regarding these certifications. <br />Sincerely, <br />envy .
