Permit Application, Wallenberg Lakes, 112c Permit <br />Application No. M-200051, Adequacy Review <br />Dear Mr. Schenderlein: <br />The Division of Minerals and Geology has received your application for the Wattenberg Lake 112 c <br />Reclamation Permit and has reviewed the application for adequacy issues. The Division is required <br />to make a recommendation to the Mined Land Reclamation Board (NLRB) no sooner than October 10, <br />2004 and no later than October 27, 2004, therefore, your response to the following adequacy review <br />concerns should be received by the Division by October 15, 2004, in order to give the Division some <br />time to review the responses. <br />The Division's comments/concerns are as follows: <br />1. Exhibit A- Legal Description <br />Exhibit A (page 1 of the application) describes the permit area as " A tract of land in portions <br />of Sections 25 and 36, Township 1 North, Range 67 West and Section 30 ,Township 1 North, Range <br />66 West of the Sixth Principal Meridian, Weld County, State of Colorado as described in the attached <br />description." On the next page (the attached description), the site is described as " A tract of land <br />located in portions of Section 25, 30 and 36, Township 1 North, Range 67. West of the 6a' P.M., Weld <br />County, Colorado, more particularly described as follows:" Please determine which of these <br />descriptions is the correct one, and provide the Division with the appropriate legal description. <br />2. Exhibit D- Mining Plan and Exhibit S- Permanent Manmade Structures <br />a) On page 4 of the application it is stated that the depth of the soil and overburden ranges from <br />less than one foot to five feet and that the aggregate material ranges up to 41 feet. Therefore, it <br />appears that it is possible that high walls could be as much as 46 feet tall.
