groundwater elevation. The Division also requests that the applicant clearly define the hydraulic gradient <br />and flow direction between Trout Creek and the pit, and between the Yampa River and the pit since the pi[ <br />excavation will be signficantly lower than the invert of the channel for both Trout Creek and the Yampa <br />River, ie: will groundwater Flow from the creek/river to the pit and at what rate, or will groundwater Flow <br />towards and recharge the creek/river? <br />27. In conjuction of item 28 above, the Division requests that the applicant provide a water balance to <br />quantify the various inflows and outflows expected at the Camilletti Milner Pit #2 throughout the mining <br />operation. The water balance should include rates of water use for evaporative loss, operational needs such <br />as dust suppression as well as the expected discharge rate For cottonwood/willow irrigation, and for <br />discharge back to Trout Creek and/or the Yampa River. Please address. <br />6.4.8 EXHBIT H -Wildlife Information <br />28. The applicant has provided in Exhibit H a description of the game and non-game resources on and in <br />the vicinity of the application area as required by Rule 6.4.8(1). The applicant has also provided a copy of <br />a June 25, 2000 response letter from Elizabeth K. Miller of the State of Colorado Division of Wildlife <br />(DOW) to the Rout[ County Regional Planning Department regarding a Special Use Permit for the <br />Camilletti Milner Pit #2 operation. However, an objector to your Mazch 31, 2001 Regulaz 112 Application <br />states "the area wildlife has not been portrayed correctly in the Camilletti application. Bald eagles are 3/4 <br />mile upstream, not 8 miles downstream as the applicants said. The Golden Eagles are nesting less than 1/4 <br />mile of the mine site". (Please see attached objection letter from Loretta Van Norstrand dated May 7, <br />2001). In response to the objectors comment, the Division will require a reply from the DOW that clarifies <br />the location(s) of sites occupied by bald and/or golden eagles in the vicinity of [he Camilletti Milner Pit #2, <br />potential impacts [o [he eagles from the proposed operation, and any recommended mitigation measures. <br />Any written comments generated from the U.S. Fish & Wildlife Service which verify the potential or <br />absence of potential impacts to the eagles and which provide recommended mitigation measures may also <br />be helpful. Please respond. <br />6.4.12 EXHIBIT L -Reclamation Costs <br />29. As required by Rule 6.4.12 please provide a reclamation cos[ estimate to cover all costs [hat would be <br />incurred by the State of Colomdo during a maximum disturbance scenario, as quanitified in Item 7. The <br />reclamation cost estimate should include pumping costs to dewater the pit at the time of maximum <br />disturbance (assuming the pumps have been shut off and the pit has filled with water), itemized costs for <br />any planned wetland and/or riparian habitat reclamation, and costs for mobilization/demobilization of <br />reclamation equipment. Please address. <br />6.4.13 EXHIBIT M -Other Permits & Licenses <br />30. The applicant states on page 26 that a 404 Permit will not be needed from the U.S. Army Corps of <br />Engineers (COE) for planned activities at the Camilletti Milner Pit #2. Recent telephone conversations <br />with Sue Nall of the COE indicate that there may be a need fora 404 Petmit in the future, pending review <br />of public comments received by their Office for the proposed operation. In the event that a 404 Permit <br />does become necessary, as determined by the COE, the Division requests that the applicant keep the <br />Division informed of such a change and would appreciate a copy of the permit following issuance. Please <br />comment. <br />
