Box 519 <br />Greeley, CO 80632 <br />RE: La Poudre Sand & Gravel, Permit No. M-83-090 <br />Status Request for the Substitute Water Supply Plan <br />Dear Mr. Gregg, <br />The Division of Minerals and Geulogy received correspondence from the Office of the State Engineer <br />("OSE") regarding a number of gravel pits that may not have a Substitute Supply Plan. The Hall-Irvin <br />Construction- La Poudre Pits I and 4 is included on the list that may not have a substitute water supply <br />plan in place or water court decree approve by the OSE. If Hall-Irwin does not have the appropriate water rights in place, the reclamation plan <br />cannot be achieved and an alternate reclamation plan is required. Please inform the Division the status of <br />the Substitute Supply Plan or Auementation Plan for [he La Poudre Pits 1 and 4 (or relevant pits if the <br />numbering sequence has changed). Without such plans, the Division will be required to adjust the <br />financial warranty to backfill the gravel pits two feet above the maximum groundwater elevation. <br />The Division would appreciate a written response no later than December 22, 2000. If no response is <br />received, the Division will adjust the financial warranty accordingly. You will be notified of such <br />increase.
