M M <br />,~~ <br />EXHIBIT G <br />DATER INFURlIATIUk <br />A recent Colorado Supreme Court F.uling requires that a cell Permit be obtained <br />to operate a gravel pit that has intersected ground eater, and leaves it <br />exposed to evaporation. <br />No xell permit is required if the pit is filled in to above the ground water, <br />and is not further mined below that depth. <br />Records should be kept annually on presence or non-prasance of ground :rater. <br />This is to prove that standing water from precipitation is not ground ~;ater. <br />If ground water is intersected and left exposed, then it must be augmented by <br />the operator. <br />The bottom of a "dry" pit should slope to a rocky-gravelly area free of clay <br />and plasticity, to allox for infiltration of precipitation so that ponding does <br />not occur.
