Johnson <br />Summit Engineering Co. <br />1317 State Ave. <br />Alamosa, CO 81 lOl <br />CT°T~ OF <br />III IIIIIIIIIIIIIIII <br />RE: Pit 1 (File M-99-073) MLRB reconsideration of corrective action date and additional permitting issues <br />Dear Mr. Johnson: <br />As you are aware, on November 18, 1999, the Colorado Mined Land Reclamation Board reconsidered the <br />corrective action date specified in the Cease and Desist Order accompanying Notice of V iolation MV-99-022 by <br />which a 110 permit must be secured for Pit 1. The currently required corrective action date of November 26, 1999 <br />was extended by the Board to December 10,1999. <br />As a result of the public notice made of the application for Pit I, which you provided and which specified a <br />comment period of less than the ] 0 days required by Minerals Rule 1.7.2, you, as agent for Evan Melby, are <br />directed to republish the notice with a correct comment period identified. <br />When your response to the Division's adequacy review is made, you should immediately place a copy of that <br />response with the copy of the application on file with the County Clerk and Recorder, secure a receipt indicating <br />that placement and provide the receipt to the Division.
