•
December 7, 1980
hlr. Mark Loye
Mined Land Reclamation
423 Centennial Building
1313 Sherman Street
Denver, Colorado 80203
Re: MacKenzie Pit MLRB ~~ 80 - 224
Dear Mr. Loye,
~ III IIIIIIIIIIIIIIII
~°i_a ._.. r, ~~
!' 1 r;180
~,~ ~,
The following information is in response to your letter of
December 1, 1980.
Exhibit A:
1. The three page legal description defines the metes and bounds
measurements of a tract of land owned by l~remont Paving, Inc. The
pit itself is located in the extreme sout}~west corner of that tract
as shown in Exhibit C-2 and .identified as "Pit Area".
2. The pit area Lo be mined is located ir, the SE 4 of the SE 4 of
Section 1, T 19 S, R 70 W of the 6th PI`1 ir, Fremont County.
Exhibit B:
1. As indic;sted, the bottom of the mined area will be at the same
elevation of the present office building and vehicle shop. I under-
stand thar_ is also the bottom of the useful gravel deposit. There-
fore, the gravel deposit to be mined is found in an embankment that
is approximately 25 feet higher than tl,e finished elevation.
2. The surface layer of topsoil is about 7 inches deep (see SCS
Exhibit D). Since this is "go-back" ciopl.and, we propose to stock
pile the top 10 to 15 inches which has been involved in former
farming practices and can nor. be separated as one might do in the
undisturbed site mentioned by SCS,
3. This request does not seem reasonable for several reasons.
First, the stockpile could not erode away beyond its edges when
placed on level land. The suggested sloping only spreads the stocked
material over a wider area and would require second and third hand-
ling in order to mine the gravel deposit i.t would then cover. Second,
seeding perennial grass is unnecessary and is certainly requiring a
standard far higher than the surrounding weed cover on the long
abandonded cropland (see the SCS vegetation report). 'Phe old stock
pile shown in the photograph attached to Exhibit C-3 is protected
from wind erosion by natural reseeding that will Ue duplicated the
first year.
For these reasons we respectfully request that this item 3 not be
imposed as a requirement upon us. However, if this matter is ordered
by the Board after hearing our written appeal contained here-in, we
will of course comply.
