TERMS AND CONDITIONS <br />Effluent Limitations <br />Beginning no later than the effective date of this permit and lasting through Decattber 31, 1999, the permittee is <br />authorized to operate under the terms and conditions of this permit. The following points have been specifically <br />identified for monitoring purposes: <br />OOlA Arequa Gulch at Station AG-1.5 (for use when no stormwater is present) - <br />OO1B Arequa Gulch at Station AG-1.5 (for use when stormwater is present) <br />002A Pregnant Solution Storage Area Leak Collection and Recovery System (PSSA-LCRS) <br />003A Ore Storage Area Leak Detection System (OSA-LDS) <br />004A Springs forming Arequa Gulch within Arequa Gulch Rock Storage Area <br />OOSA Non-Spring Seepage from Arequa Gulch Rock Storage Area (does not include stormwater), At Discharge <br />Into Diversion Ditch Surrounding the Valley Leach Facility <br />006A Non-Spnng Seepage from Arequa Gulch Rock Storage Area, Mixed With Stormwater, At Discharge From <br />Diversion Ditch to Arequa Gulch Below the Valley Leach Facility <br />007A Discharges From the Valley Leach Facility That Qualify for Annual Precipitation or Storm Exemptions <br />In accordance with the Water Quality Control Commission Regulations for Effluent Limitations, Section 10.].3, and <br />State Discharge Permit System Regulations, Section 6.9.2, 5 C.C.R. 1002-2, the permitted discharge shall not contain <br />effluent parameter concentrations which exceed the following limitations specified below or exceed the specified flow <br />limitation. <br />a. "No Discharge" Linutation <br />Except as allowed under the exemptions described in sections Part I.A.1.6. and c., the Cresson Mine cyanide <br />heap leach operation, including all ancillary facilities located within the boundaries of the project area, may not <br />result in a point source discharge of process water or combined process water/stotmwater to surface waters of <br />the State. In addition to any immediate notifications required under the exemptions listed below or the spill <br />provisions of the permit, and the submittal of monthly discharge monitoring reports (DMR's), the permittee <br />shall submit an annual report each year, as described in detail ta Part I.E.3.c. of [his permit, and must <br />demonstrate in that report that no discharge of process water has occurred. Such demonstration may <br />incorporate the analysis of Flows, pollutant concentrations or pollutant loadings. Should the permi[tee be unable <br />to provide such a demonstration, or the Water Quality Control Division determine that any discharge of process <br />water has or ma}• have occurred, the permit may be reopened in order to modify its [erttis and conditions so as <br />to further evaluate or to control the discharge. <br />INDBP +rVF) <br />
