SULLNAN Li/I D ~~ <br />SUBJECT: PRIDEMORE CONSTRUCTION INC -JESSE LEE PIT, MINING P N M-84-043 /n'I/~ <br />DATE: 10/26/98 <br />CC: JIM DILLIE, CDMG; DMSION 2 OFFICE <br />On July 24, 1998, our office received a copy of the July 15, 1998, inspection report by the Division of <br />Minerals and Geology. The report (attached) indicates probable water rights issues, including two <br />ponds created in the southern pit area exposing ground water and ground water or surface runoff <br />intercepted by a cvt bank in the northwest comer of the pit. We have not identified a permit or <br />Substitute Water Supply Plan for any of this operation's activities. The operator also screens and <br />washes excavated material using an unknown water source which may not be permitted or decreed <br />for industrial use. <br />Please inspect the site and review any information you may have to determine <br />• the estimated ground water exposed in the ponds (or if the ponds arise from a surface water <br />sowce), <br />• the water source and extent/impact of the "seep' and any proposed remedial action, <br />• the water source(s) for their operations and the legality of such use, <br />• identify any decrees, permits, or SSP's you may be aware of for the operation, and <br />• anything else you believe would be useful in evaluating compliance. <br />You may wan[ to contact Jim Dillie, the CDMG inspector, at (303) 866-3567, for additional location <br />and operations information or to accompany you. If found in noncompliance, we will use the <br />information gathered at your and CDMG's inspections to drak a letter ordering them to take actions <br />to achieve comphance with statute. As additional background information, I have enclosed copies of <br />previous (sometimes conflicting) inspections and a past letter, for which we received no response. <br />Thank you for your assistance.
