highway to a culvert that goes under the highway and also dumps into the Deer <br />Trail Ditch. It is unknown what pond or flow source this channel was for. <br />5. Conclusions: <br />What was discussed onsite was that discharges from Pond B must not go into <br />the FMC. That would entail that the hole in the Ditch (Photo #16) be repaired <br />and the Ditch cleaned of vegetation downstream of where Pond B discharges <br />into the Ditch. The Ditch will also need to be properly maintained so that the <br />discharges from Pond B won't get into the FMC. <br />Another item discussed onsite was being able to shut off any or all flows from the <br />Deer Trail Ditch into the FMC, especially in the non-irrigation season for the FMC <br />when maintenance in the canal prism or on the berm take place. So, the two <br />pipes that can discharge into the FMC (Photos #18 & 20) will need valves <br />installed (if not already present) so that all flows can be stopped when needed. <br />The travelers asked Merritt for a copy of any testing performed on the sample <br />taken by the Delta County employee prior to this site visit. This data should also <br />be provided to the State agency that oversees the testing and/or discharge <br />permit for this mine. <br />After returning to the office, information on the discharge permits for Bowie <br />Resources was obtained by John Ozga. There were several amendments to the <br />original permit for this mine (Bowie No. 2 Mine, Bowie Resources, LTD. CDPS <br />Permit Number CO-0044776, Delta County), but the latest version seems to <br />indicate that up to six of the permitted outtalls (001-006) directly or eventually <br />enter Deer Trail Ditch. Discharges range from surface runoff, to mine drainage to <br />treated domestic wastewater. <br />While onsite we looked at Outfall 001 (Photo # 15) which is for Pond B. The last <br />area looked at was another outtall (on the list of those in the permit), but it is <br />unknown which. The locations of the other four ouffalls referenced in the permit <br />that discharge into the Ditch are unknown. When we were onsite for this trip, the <br />number of outtalls and other information contained in the permit and it's various <br />amendments were unknown by the travelers. There is concern that water in <br />Deer Trail Ditch is discharged into the FMC at least two points (Photos #18 & 20) <br />upstream of the area where discharge from Pond B enters the Ditch. There may <br />be other points where water can be discharged into the FMC from the Ditch. <br />It is unknown if the operators of FMC, the Fire Mountain Canal and Reservoir <br />Company, are aware of the various outtalls covered by this permit that enter the <br />Ditch and at times are discharged into the FMC. The permit indicates that there <br />is an agreement between the owner of the Ditch and Bowie Resources for using <br />the Ditch for flows from the various outflows, but it is unknown if any of the users <br />3 <br />
