Simpson, P.E. <br />State Engineer <br />As you are aware, the Board of Examiners of Water Well Construction and Pump Installation Contractors <br />ordered the abandonment of the existing well that was the subject of the above-referenced Water Well <br />Permit Application by Mel J. Martinez for exempt household, livestock, and home lawn and garden <br />irrigation uses (BOE File No. 99-BC-011). Pursuant to your telephone conversation today with Dave <br />McElhaney, staff to the Board of Examiners, the Division of Water Resources understands that the well <br />was constructed as a monitoring well to fulfill a requirement of a Division of Minerals and Geology mining <br />permit for the Chimney Rock Coal Mine -Kaiser Ventures site. Therefore, as an alternative to <br />abandoning the well and to comply with the mining permit, your client would like to permit the existing <br />structure as a monitoring well. <br />Preliminary review suggests that the structure's construction would be acceptable for monitoring <br />purposes only. I have transferred receipt number 443954 to the enclosed Monitoring/Observation Well <br />Permit Application. Please have your client complete the enclosed application and submit it to our office <br />for evaluation.
