Dear Mr. Barnhart:
Please be advised that there are new permit application requirements based on
rule changes which became effective January 1, 1991. Those which pertain to
the notice requirements at the time of application submittal are noted below:
° Prior to submitting the application to the Division for filing, the
applicant shall send a notice, on a form approved by the Board, to the
local board of county commissioners and, if the mining operation is
within the boundaries of a soil conservation district, to the board of
supervisors of the soil conservation district (Rule 2.2.2(1)).

application to the local board of county commissioners and, if the

placed with the local county clerk and recorder (Rule 2.2.1(19)).
Failure to follow these notice requirements will result in a decision to deny
your application. You may amend your application by submitting proof of these
notices. In accordance with Rule 1.5, a new decision date will be established
90 days from the date of receipt of these notices. If you have already
initiated publication, you will need to republish notice which specifies the
final date for receiving comments is the 20th day after the fourth publication
or the next regular business day.
