Mr. Tom Schreiner, Division of Minerals and Geology <br />April 15, 2005 <br />Page 5 <br />~~ <br />CIVIL RES'AU RCES,LLC <br />Comment 15: In conformance with Rule 6.4.7(3), please revise the estimate of project water .. , <br />Response 15: The water required to reclaim this project ii it were abandoned would include construction <br />water only. The cost of water to fill a reservoir is not a cost to complete the reclamation it <br />is an "end use". After acceptance as a lined storage facility by the State Engineer's <br />Office, the facility is considered complete and no further augmentation (TSSP or <br />otherwise) is required. In other words, the project will have been reclaimed and no <br />continuing injury to water rights or other real property rights is occurring and therefore no <br />additional water is required. <br />We believe our response information is reflective of our verbal discussion of each comment and therefore <br />should adequately address your comments.
