<br />t <br />APPENDIX Z <br /> <br />Unsuitability Analysis and Report <br />This unsuitability analysis and report was prepared for a 180-acre tract <br />of federal coal lands described as: <br />T. 35 N.. R. 11 W.. N.N.P.M. <br />Section 32: SEl/95Y1/9, S1/2NE1/9SE1/4, <br />NWl/9SE1/4, S1/25E1/4 :~_ <br />In LaPlata County, Colorado <br />The tracts ware identified in a coal lease modification application <br />(P-058300 and C-29125) submitted by National Ring Coal, Inc., on April 27, <br />1988, and was amended on October 12, 1988. The tracts lie adjacent to and <br />west of existing federal coal lease C-29125. Tha leaseholder of that <br />federal coal lease is National Kinq Coal, Inc.. <br />The tracts are located approximately four miles southwest of the town of <br />Hesperus, Colorado, in LaPlata County. The 180 acres consists of <br />federally-owned coal estate overlain by private lands. Thera is no <br />proposed surface disturbance other than possible subsidence to the total <br />application area. <br />In compiling this analysis and report the unsuitability criteria published <br />n 93 CFR 3961 were used. <br />~he unsuitability criteria were applied individually to the total proposed <br />lease tract and maps were developed showing the applicability of the <br />criteria. Afcar all the criteria were applied, the exceptions of each <br />criterion found to be applicable werE examined to detrri:ine if the <br />exceptions ware applicable. After the process had been coaplrt~d. a <br />summary stating tY.e conclusions of the report were written. <br />t~nsuitabi~it~ Criteria <br />Sea 93 CFR 3961 (Appendix II) <br />Criterion Number 1 -- Federal Land Systems <br />Find,~s: None of the private surface lands in this 180 acre tract <br />lie in any of the land systems or categories listed in the <br />criterion. <br />Analysis: The modification areas should be considered suitably for <br />further coal lease consideration due to this criterion. <br />Criterion Number 2 -- Rights-of-Way and Easements <br />Findings.: The Master Title Plat for T. 35 N.. R. 11 Y., NMPM <br />• indicates that no rights-ol-way or easements were reserved when the <br />surface was patented. Patent numbers 229072 and 319309 have <br />16 <br />November 1993 <br />
