~`R9PPRR P~I~IP~C Z~C.

January 28, 1987
CERTIFIED P297324766
Mr, Bill Holegate
Mine~Safety and Health Administration
District 9
P.O. Box 25367
Denver, CO 80225
Dear Bill:
In accordance with Colorado Surface Coal Mining Reclamation Act regulations
4.19 Protection of Underground Mining and 4.22 Concurrent Surface and Under-
ground Mining, Trapper Mining Inc. is requesting a variance to the 500-foot
barrier, measured horizontally, that shall be maintained between surface and
underground mining activities. To comply with these regulations governing
variances to this rule, ioint approval must be granted by Colorado Mined Land
Reclamation Division (CMLRD) and by Mine Safely and Health Administration
(MSHA).
r
• Trapper Alining Inc. is applying for the variance so that improved coal
resource recovery may be obtained from the area. It is estimated that the 75
acres included within [he 500-horizontal barrier contains 930,000 tuns of sur-
face mineable coal. The area for which the variance is requested is shown on
Map TR-32-1 for the 1987 C Pit Permit Revision, and on Map M-B for the 1988 to
1992 Permit Renewal submitted to [he CMLRD.

Most of the underground workings shown on these maps are abandoned room and
pillar mining areas for which an estimated 85% extraction was accomplished.
No currently-active headings fall within 500 horizontal feet of the planned
blasting area, although during the permit term the possibility exists.
Due to [he nature of the geology and the vertical separation of the two mining
operations, Trapper feels the health and safety of the underground miners will
no[ be can promised. To insure the safety of Empire Energy's Eagle No. 5 Mine
workers, blasting within [he 500-Foot horizontal barrier area will be done
during Empire's shift changes when none of their workers are in the area. To
insure the safety of Empire activities, Trapper Mine will use a controlled
blasting schedule which will be coordinated with Empire Energy Corporation.
cont.
P.O. Box 187 - Craig, Colorado 81626 (303) 824-44D1
