• road crosses the North Fork of Bolton Draw upstream from Weir #1. <br />Analyses of these water samples are found at the end of this <br />Appendix. These analyses demonstrate that surface water quality <br />is much better than groundwater quality in the mine vicinity. <br />Two surface water monitoring stations will be maintained in <br />the North Fork of Bolton Draw. Weir #1 which has been in existance <br />since May, 1980 monitors water from both the North Fork as well as <br />the Middle Fork of Bolton Draw. A second monitoring site will be <br />established when the larger culvert is placed beneath the proposed <br />haul road between Pit 1 and Pit 2. Monitoring at this location <br />will show the flow rates attributable only to that portion of the <br />North Fork of Bolton Draw where mining will take place. Both sites <br />will be monitored on a weekly basis when flows are evident. Both <br />locations will also be sampled quarterly for water quality. <br />Only one adjudicated surface water right exists in the Bolton <br />Draw drainage. This right, known as the Bolton Ditch, is located <br />• in the NW; of the NE; of Section 11, T8N, R78W as identified on <br />Plate 4 (Willard Owens report). Filed under Case No. W-846, this <br />right bears an appropriation of 15 cfs, has an appropriation date <br />of October 1, 1947, and a previous adjudication date of December <br />31, 1974. Diversion records, presented in Table III of the Willard <br />Owens report, show the maximum estimated historic diversion to be <br />10 cfs with flows in most years averaging 2-5 cfs. <br />In addition to this right, there are a number of other surface <br />water facilities in Bolton Draw. In the extreme upper end of the <br />draw, in Section 24, T8N, R78W, there are a number of small springs <br />used for stock and wildlife watering. Stock ponds lie in Sections <br />2 and 10 of T8N, R78W and a small reservoir lies below the workings <br />of the Marr Mine in Section 35, T9N, R78W. An extension of the <br />Spear Ditch runs along the southeast edge of Bolton Draw, however, <br />this ditch delivers Michigan Creek waters to lands behind the 3- <br />Rivers Ranch in the Michigan Creek drainage and does not impact <br />• Bolton Draw <br />-71- <br />
