WHEREAS, ELAM COiJSTRUCTION, INC., a Colorado corporation herein sometimes
referred to as "Operator", and the Vagneur Ranch Company, a Colorado corporation
and Elam's lessor, have applied to the Board of County Commissioners of Pitkin
County, Colorado, for a Sand and Gravel Permit pursuant to the requirements of
'the Piktin County Sand and Gravel Regulations; and
WHEREAS, Elam has operated a sand and gravel operation at the present Woody
Creek site for eight (8) years and has demonstrated its ability to comply with
Sand and Gravel Regulations and the terms of the current Gravel Permit Agreement
issued in 1974; and
WHEREAS, the Piktin County Planning and Zoning Commission has unanimously
approved this application; and
WHEREAS, the Board of County Commissioners are aware of the substantial need
for gravel in the Roaring Fork Valley and of the desirability of locatinc, a
•~gravel and asphalt service as close as practical to the area of actual use; and
WHEREAS, the relatively isolated location of the gravel pit site is compatible
with adjacent and proposed land uses for the area;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin
County, Colorado, as follows:
1. A sand and gravel permit is hereby granted for a period of five years
commencing on October 9, 1979, and continuing until October 9, 1984.
Also, special review permission is granted fora like period to operate
a hot-mix asphalt plant and concrete batch plant. .Should the Pitkin
County Sand and Gravel Regulations be amended to allow a permit period
longer than five years, this permit shall be extended for such period
or ten (10) years (whichever period is shorter), that is, continuing
no later than October 9, 1989.
2. Representations as made by the applicants, in documents, maps, and
reports are hereby incorporated as conditions of this permit as on
