<br />EXHIBIT D <br />MINING PLAN AND TIMETABLE <br />I,O(,ATION <br />The property is located in Weld County approximately 2.50 <br />miles northwest of Platteville Colorado along the South Platte <br />River. Please refer to Exhibit B - Vicinity Map for the property <br />configuration and the relationships to surrounding geological <br />features. The area to be mined lies in the river bottom area <br />west of the We~tP*'~ Mutua~n~*~h end south and east of the river. <br />Near the west center part of the property the St. Vrain River <br />enters the Platte. <br />The permit area is 1,239.40 acres ± and consists of two <br />parcels; one owned by Tom Sharkey and the other by Krystal <br />Hoffschneider. Mr. Sharkey owns 1,171.19 acres ± and Ms. <br />Hoffschneider owns 68.21 acres ± in the southeast part of the <br />site. The PRE-MINING MAP - EXHIBIT C show how the area looks at <br />this time. The northern boundary line of the mined area is the <br />center line of the rivefand the southern boundary is Weld County <br />Road (WCR) 36 and the Western Mutual Ditch's overflow return <br />ditch. The east line follows the east line of Section 2, T-3-N, <br />R-67-W and Section 35, T-4-N, R-67-W, to an intersection point <br />with the Western Mutual Ditch. From there it follows the center <br />line of ditch to where it crosses the property line near the <br />intersection of WCR 23 and 40 z. It then goes north along the <br />east side of Section 26, T-4-N, R-67-W, to the river. Fences <br />delineate large sections of the south and west line of the permit <br />area. The gravel deposit is an alluvial deposit that averages <br />45+ feet deep across the property and the site elevation is <br />approximately 4750 feet, sea level datum. <br />There are a number of gas/oil wells and supporting <br />facilities on the site. Their location is shown on all maps and <br />the approximate location of the gaslines supporting the wells are <br />show. Prior to enter a minin area we_w.il_1 contact a locate <br />se_rvice_ to mark each buried_ gg- a-sl a so_ we know the exact location <br />of the line.._ All necessary precautions will be take to protect <br />and preserve these lines. This may change the final <br />configuration of a lake_and will_be_addressed_i_n our a_nn_ual <br />reports. <br />CURRENT CONDITIONS <br />Map ExhibitC shows the outline of the mining area, the <br />touching landowners, the 200 foot ownership, current topography, <br />and hydrologic features of the property. The land is presently <br />used for agricultural purposes by the landowners. Sec 'ons~f <br />the .permit area are river bottom with cottonwood trees_and <br />`riparian habitat. Some of the area is used as irrigated pasture, <br />and hay Field and some is left as dryland area because of its <br />marginal range value. Surrounding property uses, on the areas <br />outside the river bottom, include irrigated agriculture or <br />dryland pasture. The riparian areas are used by the ranching <br />operation for cattle grazing and some have oil wells located in <br />them. The area that are not actively mined during the life of <br />4 <br />
