CHAPTER II <br />THE MINNESOTA CANAL AND RESERVOIR COMPANY <br />HISTORY <br />The Minnesota Canal and Reservoir Company (commonly referred to as the <br />Minnesota Ditch Company) was certified as a non-profit corporation under <br />the laws of the State of Colorado on March 28, 1927. <br />Forest Service records indicate that the Department of the Interior granted <br />an easement for the Dam on September 30, 1905. The Forest Service records <br />also indicate that workers from the Minnesota Ditch Company worked on the <br />Dam from 1901 to 1908. The work completed during the period from 1905 to <br />1908 is described as repairs to the Dam. This work consisted of enlarging • <br />an existing Dam. The original Dam was constructed approximately 100 years <br />ago and the Company has been providing irrigation water as an organization <br />for that length of time. <br />A copy of the incorporation certificate is attached in the Appendix. <br />POWERS AND AUTHORITIES <br />The Minnesota Ditch Company is a non-profit Corporation at this time. As <br />such, the Company's powers and authorities are limited. The Company has <br />the right of eminent domain but has no taxing authority. The Company's <br />only source of income is through assessments of its shareholders. <br />II-1 <br />
