BANTA, Dlreetor
April 26, 1989
Mr. Jim Hendricks
Pueblo Coal, Inc.
278 Sawyer Drive, Suite lA
Durango, CO 81301
Dear Mr. Hendricks:
We received the fax of your letter requesting a continuance of the renewal
review period on April 24, 1989. The letter addressed the necessary points
to allow us to extend the renewal review period and you need to initiate
publication of the newspaper notice as soon as possible. The Notice must
be published once a week for two consecutive weeks. We have modified the
wording of the proposed notice as indicated on the enclosure.
The next step in the process is to draft a written agreement regarding the
review schedule, with specific commitments and time frames. Two significant
concerns we have with extending the review period for the length of time you
have suggested are the issue of reclamation bond adequacy and the question
of Pueblo Coal Company's financial ability to perform environmental monitoring
and site maintenance as required by the permit and regulations. We have not
yet received the letter which you had indicated would address the latter issue.
Mike Savage and I will be discussing these issues with Mike Long and the
Attorney General's office and we will be contacting you regarding the extended
review schedule within the next two weeks. Please contact me if you have any
questions.
Sincere ,
Dan T.
