At this time, it appears that all remaining <br />• reclamation issues have been satisfactorily addressed. Therefore, the <br />Division gives its approval to proceed with the reclamation plans specifically <br />addressed in the various submittals since the inception of the Agreement <br />between the Colorado Mined Land Reclamation Division and the Rockcastle <br />Company dated June 26, 1990 (The Agreement). It is understood that the most <br />recent submittal with regard to each individual reclamation item is the <br />approved plan for that specific item. <br />Review of the June 26, 1990 Agreement reveals that upcoming reclamation <br />activities will- resolve items III2a..,_III2b., IV2., IV3., IV4. and IVS. <br />Remaining parts of the Agreement which have yet to be fulfilled do not deal <br />with reclamation specifically and can be handled concurrently with the actual <br />field work. <br />Prior to any earthwork the Division respectfully requests the following: <br />1. Clarification and resolution of the access problem. <br />2. A commitment to repair existing gullies in excess of 12 inches on <br />the Pit areas and contour furrow repair where necessary. <br />3. As per my discussion with Tom Leidich of ACZ, Inc. commit to <br />construct the outslope of Pond 5/6 with a 2.5:1 slope to comply <br />with Rule 4.05.6(lll(f). <br />4. Rockcastle will re-establish topsoil markers and/or stake the <br />topsoil pile footprint to avoid unnecessary disturbance until said <br />pile requires transport. <br />
