Schmieding, Reclamation Specialist <br />Mined Land Reclamation <br />1313 Sherman, #723 <br />Denver, CO 80203 <br />Dear Jim: <br />The following remarks are in response to the July 6, 1979 memo from <br />Jeris Danielson to Chips Barry. <br />1. Water Rights. Flatiron possesses adjudicated water rights in the <br />form of two wells (W-11-11131 and L-9) in connection with adjacent pro- <br />perty to the north. Please refer to Case No. 3481, Division I Water <br />Court, State of Colorado, October 7, 1976. Mr. Thomas J. Aron, Jr., <br />water referee, Division I, has confirmed and approved uses of gravel <br />washing and irrigation for these two wells. <br />2. Well Drawdown. Please see page G-7 of the permit application, 3rd <br />paragraph, Drawdowns will extend approximately 1,000 feet ." <br />Comparing the maps on pages G-4 and C-1 we see there are no wells <br />within 1000 feet of mining at East Rigden. <br />3. Irrigation Lateral. During mining at East Rigden water can still be <br />conveyed to the Porrison property by changing the route of the irrigation <br />lateral southward. However, Flatiron currently has an option on the <br />Morrison property and expects to have title to it as soon as a pending <br />legal decision to clarify title is made, so it is unlikely that the <br />lateral will, in fact, ever need to be realigned. <br />4. Reclamation Drainage. There are several alternatives for draining <br />the site. The Boxelder Ditch could be the carrier from the southeast <br />corner of East Rigden to the Poudre River. Or, a separate drainage <br />ditch could convey water from the same location to the Poudre. However, <br />the most likely drainage plan is the one outlined on page G-13. It <br />It envisionages the purchase of the Morrison property and a reclamation <br />plan which links the whole Flatiron landholding (East Rigden, Morrison, <br />Baumgartner), with the westerly portions on the expanded site draining <br />to a lake created by mining at Baumgartner.
