Cattany <br />DWhlon Diregor <br />Nriunl Resaura Trustee <br />Listed below are adequacy review comments on the above-captioned Regular 112 Application for 526.70 <br />permitted acres. The decision date for your application is scheduled for February 7, 2005. Therefore, I <br />would appreciate a response from you on or before January 31, 2005. (Your response should include two <br />(2) copies). A]] written comments and objection letters that our Office received during the public comment <br />period have already been forwarded to you. In addition, we have included a complete set of all review <br />comments and objection letters received as an attachment to this adequacy letter. We request that you <br />provide a response to each of the specific adequacy concerns presented by the objectors as an addendum to <br />your response for the adequacy concerns presented in this letter. Two (2) copies of your adequacy <br />response must be submitted and received by the Division by no later than January 31, 2005 to allow <br />Division staff sufficient review time. If the applicant requires additional time to adequately respond to the <br />concerns presented in this ]otter, the applicant may elect to waive their right to a decision within 90 days <br />and request an extension of the decision date. Such a request must be made in writing and must be <br />received on or before February 7, 2005. Please be advised that your application maybe deemed <br />inadequate and the Division may recommend denial of such application on February 7, 2005 unless the <br />following adequacy review iteFns are address to the satisfaction of the Division. <br />6.4.1 EXHIBIT A -Leval Description <br />Accuracy -The City of Black Hawk has challenged the accuzacy of the legal description of the permit area <br />as specified in their objection letter, received by the Division on December 30, 2004. Please address. <br />6.4.3 EXHIBIT C -Pre-Minine and Minine Plen Mao(sl of Affected Lands <br />Contiguous Property Owners - LL. & L.M. Turner have alleged inaccurate listing of configuous <br />property owners. See attached correspondence from I.L. & L.M. Turner received by the Division on <br />December 15, 2004.
