Colorado 80215 (3D3) 274-0277 Fax (303) 274-8329 www.banksandgesso. com Enclosed is a copy of the published notice for the MMRR Quarry project, giving notice that Clear Creek District Water Providers, LLC has filed application number M-2004-067, as amended, with the Colorado Division of Minerals and Geology. A legal description of the proposed permitted site is found on the Public Notice and an updated vicinity map is also enclosed for your reference. The most recent Public Notice concerned an amendment to the quarry application. That amendment involved a proposed paint of access directly across State Highway 119 from the Clear Creek Convenience store, at Milepost 1.3. That point of access has since been withdrawn, with the current proposed point of access being approximately 720 feet up-canyon along State Highway 119. The current proposed point of access is depicted on the enclosed vicinity map. Further information regarding the point of access and other aspects of this proposed project may be obtained by inspecting the project file .maintained for public inspection by the Gilpin County Clerk and Recorder or the file maintained by the Division of Minerals and Geology. The Silver Dollar Metropolitan District is being notified of this application based on recent information submitted to the Division of Minerals and Geology regarding the District's potential interest in property locafed within 200 feet of the affected lands of this proposed permit. The Silver Dollar Metropolitan District may own or share an ownership interest in several light poles in the right-of-way of Colorado State Highway 119 near the project site. In accordance with state mining regulations, this notice is provided to the Silver Dollar Metropolitan District with the assumption that the District has an ownership interest in the land surface within 200 feet of affected land. Based on public record, we have been unable to determine the status of the District's interest in land surface within this 200 fool distance of the proposed quarry (particularly within 200 feet of the driveway access approved at SH 119 Milepost 1.54). To facilitate cooperation and appropriate planning, please consider forwarding to the Division of Minerals and Geology and/or to our office, as the permitting representative, documentation of the District's property interests in this area. For the purposes of this notice, please note that an opportunity for public comment will be specially available to the Silver Dollar Metropolitan District. Shou{d the District wish to file statements of support or objections to the project, the Division of Minerals and Geology will receive such comment from the District at any time up to, but no later than, 42 days of the receipt of this notice. If the District wishes to submit comments to the project applicant, or to obtain further technical information on the case, please feel free to contact the office of Banks and Gesso, LLC, as permitting representative.
