A legal description of the proposed permitted site <br />is found on the Public Notice and an updated vicinity map is also enclosed for your reference. <br />The most recent Public Notice concerned an amendment to the quarry application. That <br />amendment involved a proposed point of access directly across State Highway 119 from the Clear <br />Creek Convenience stare, at Milepost 1.3. That point of access has since been withdrawn, with <br />the current proposed point of access being approximately 720 feet up-canyon along State Highway <br />119. Please note that the current proposed point of access is depicted on the enclosed vicinity <br />. map and has been permitted through Access Management personnel within CDOT (Anna Welch). <br />Further information regarding the point of access and other aspects of this proposed project may <br />be obtained by inspecting the project file maintained for public inspection by the Gilpin County <br />Clerk and Recorder or the file maintained by the Division of Minerals and Geology. <br />The Colorado Department of Transportation is being notified of this application based on research <br />regarding ownership interests in the land surface within 200 feet of the proposed affected land. <br />We have noted that the relevant sections of right-of-way for State Highway 119 were obtained by <br />Right-of-Way Deed. Though an interest in the land surface under this right-of-way may or may not <br />be owned by CDOT, this notice is provided, in accordance with state mining regulations, with the <br />assumption that the agency has an ownership interest in the land surface within 200 feet of <br />affected land. <br />For the purposes of this notice, please note that an opportunity for public comment will be specially <br />available to the Colorado Department of Transportation. Should CDOT wish to file statements of <br />support or objections to the project, the Division of Minerals and Geology will receive such <br />comment from the agency at any time up to, but no later than, 42 days of the receipt of this notice. <br />If CDOT wishes to submit comments to the project applicant, or to obtain further technical <br />information on the case, please also feel free to contact the office of Banks and Gesso, LLC, as <br />permitting representative. <br />Sincerely, <br />~---- . <br />• Alex~`scl atz~-'~ <br />
