Following is a list of <br />adequacy concerns that need to be addressed in order for the application to meet the minimum <br />requirements of the ActlMineral Rules and Regulations: <br />1. Exhibit A - OK. <br />2. Exhibit B - OK. <br />3. Exhibit C -pre-mining map and mining plan map were not signed by the person who <br />prepared the documents; pursuant to requirements of Rule 6.2.1(2)(b). Please submit one <br />copy of the signed maps. <br />4. Exhibit D -water diversions and impoundments must be designed and constructed to <br />contain all overland rlmoff from the 10-year, 24-hour precipitation event, and capable of <br />adequately conveying any excess flow (PMP excluded). How does the applicant propose <br />to mitigate water rights issues if the impoundments retain water for longer than 72 hours? <br />5. Exhibit E - will the highwalls be mined at 3:1 slopes or will they be graded or backfilled <br />to 3:1 after mining ceases? <br />Will the impoundment structures be removed after mining ceases? If not, will the <br />impoundments require yearly maintenance to ensure that the structures are stable and <br />capable of containing the upland runoff from the designed precipitation event? <br />Please describe the proposed method(s) of weed control that shall be employed for all <br />prohibited noxious weed species or other weed species that seriously threaten the <br />continued development of the desired vegetation. <br />Please specify the types, mixtures, quantities and time of application of fertilization and/or <br />mulching. <br />6. Exhibit F -reclamation plan map has not been signed by the person who prepared the <br />document; pursuant to requirements of Rule 6.2.1(2)(b). Please submit one signed copy of <br />this exhibit. <br />7. Exhibit G -what about water usage at the wash plant? How much will be used and where <br />will it come from? <br />8.
