NOTICE OF INTENT TO EXPLORE PAGE t5 <br />INVOLVING REMOVAL OF 250 TONS OR LESS OF COAL <br />SPRUCE STOMP COAL EXPLORATION PLAN AREA <br />• §2.02.2(2)(d): Period of intended exploration. <br />BRL would like to commence drilling and access road and site preparation work no later <br />than September 1, 2005. Drilling at readily accessible sites would be done while sites <br />with more difficult access are prepared. <br />BRL estimates the total time to complete site preparation, drilling and geophysical <br />logging at approximately 90 days per field season spread over three field seasons, <br />assuming one rig working 24 hours per day. Drilling tours will typically be 10 to 15 days <br />of drilling and 4 days off. Also assuming aseven-day work-week, drilling and logging <br />would be completed by approximately October 31, 2007. <br />Reclamation is expected to require no more than 10 days (average two 10 to 12 hour <br />day per site} and to the extent possible will be contemporaneous with drilling. Hole <br />sealing will be contemporaneous with reclamation at the latest and is estimated to <br />average about one day per hole. <br />The program is expected to be complete by approximately October 31, 2007. <br />§2.02.2(2)(e): Right to enter surface lands not owned by the applicant. <br />' An Exploration License application has been submitted to the Colorado State Office, <br />• Bureau of Land Management, U.S. Department of the Interior, in accordance with 43 <br />CFR 3410.2- 1. The Exploration License Application is accompanied by an Exploration <br />Plan prepared in accordance with 43 CFR 3482.1(a); this Notice of Intent is a <br />restatement of that plan. An approved Exploration License and Plan will constitute <br />BRL's right to enter Federal surface for the proposed exploration activities. <br />§2.02.2(2)(f): Practices to be followed to protect the environment from <br />adverse impacts as a result of the exploration activities. <br />All exploration activities will be conducted in accordance with applicable regulations of <br />the Bureau of Land Management and applicable rules and pertormance standards of the <br />Division of Minerals & Geology. <br />Prior to construction of new drill pads and roadways, topsoil consisting of the top 12 <br />inches of soil or the entire soil horizon to bedrock, whichever is less, will be removed and <br />stored in convenient locations for retrieval and redistribution during reclamation, in <br />accordance with applicable portions of §4.06, including §4.06.2(2)(a)(1). If it appears that <br />topsoil so removed and stored will not be used for reclamation during the fall, it will be <br />seeded with afast-growing annual such as rye grass to minimize erosion during spring <br />snowmelt. <br />• Existing roads will be graded (if necessary) and new roads and drill pads will be <br />constructed in such a manner as to minimize grades, cuts and fills, overland flow <br />
