McArdle <br />Reclamation Specialists <br />Subject: Boulder County Use Permit Criterial for Limited Impact Sandstone <br />Quarrying in Steamboat Canyon, Section 6, Township 3 North, <br />Range 70 West; Eight States Stone Company, Hunter Pritchard <br />Gentlemen: <br />The Boulder County Zoning Resolution was amended on 9 October 1980 to exempt <br />open mining operations from the lengthy Special Use Review process if such <br />operations disturb less than ten acres of land and extract less than 70,000 <br />tons of rock. Since the quarry operating above was determined to be open <br />mining of a small acreage with a tonnage below these maximum use-by-right <br />levels, no public hearings are relevant before the Planning Commission nor <br />before the Board of County Commissioners for the release of a Special Use <br />Permit. Limited impact mining, however, was determined to be in excess of <br />50 cubic yards of overburden and mineral, including pits and haul roads which <br />was sizable enough to be governed by the Boulder County Uniform Building Code, <br />adopted in 1979. Chapter 70 of this code requires a grading and excavation <br />permit be obtained which may be applied for at the Boulder County Land Use <br />Department for the purposes of reviewing .and adverse effects on public ways, <br />drainages, neighboring properties or persons. <br />Parcel owners who have mining structures or buildings constructed since 1961 <br />without permits will be required to obtain the necessary building permits <br />along with the related grading permit. Such present zoning matters as buildings <br />without permits, debris on the premises, unlawful mobile homes, derelict <br />vehicles, etc. will condition the issuance of the necessary grading permit <br />where unlawful structures or buildings support the principal mining activity. <br />The Boulder County Zoning Division will expedite grading permit release and <br />issue zoning compliance statements for the Mined Land Reclamation Board's <br />purposes when no structural or dwelling permit violations exist.
