• <br />PART II <br />• Page 12 of 14 <br />Permit No: CO-0036781 <br />State Laws <br />• Nothing in Chis permit shall be construed to preclude the institution of any <br />legal action or relieve the permittee from any responsibilities, liabilities, <br />or penalties established pursuant to any applicable State law or regulation <br />under authority preserved by Section 510 of the Act. <br />10. Permit Violations <br />Failure to comply with any terms and/or conditions of this permit shall <br />be a violation of this permit. <br />11. Property Rights <br />The issuance of this permit does not convey any property rights in either <br />real or personal property, or any exclusive privileges, nor does it authorize <br />any injury Co private property or any invasion of personal rights, nor any <br />infrincement of Federal, State or local laws or regulations. <br />12, Severability <br />The provisions of this permit are severable, and if any provisions of this <br />permi*., or the application of any provision of this permit to any circumstance, <br />is held invalid, the applicaticn of such provision Co other circumstances, <br />and the remainder of this permit shall not be affected thereby. <br />13. At the request of a permittee, [he Division may modify or terminate a permit <br />and issue a new permit if the following conditions are .met: <br />• (A) The Regional Administrator has been notified of the proposed modifi- <br />cation or [ermination,and does not object in writing within thirty <br />(30) days of receiot of notification; and <br />(B) The Division finds that the permittee has shown reasonable grounds <br />consistent with the Federal and State statutes, and regulations for <br />such modification or *_ernination; and <br />(C) Requirements of public notice have been met. <br />The`iling of a request by the permittee for a pernit rodification, re•rokation <br />and reissuance, or termination, or a notification of planned changes or <br />anticipated noncompliance, does not stay any oemnit condition. <br />14, It shall not be a defense for a permittee in an enforcement action that it would <br />be necessary to halt or reduce the permitted activity in order to maintain <br />compliance with the conditions of [his permit. <br />15• Signatory Requirement <br />All applications, reports, or informa[ien submitted to the Division shall be <br />5icned and certified. <br />LJ <br />1/31 <br />
