SHELTON Director <br />Richard D Lamm <br />Governor <br />May 18, 1983 <br />Mr. Westley Potts <br />Potco Mining and Milling <br />Route 2 <br />Mancos, Colorado 81328 <br />Re: Twin Canyon Mine/Charlene Tunnel <br />File no. 83-30 <br />Dear Mr. Potts: <br />I have reviewed the materials you submitted in reply to my letter of April 14, <br />1983. I have a few final necessary comments, but I am sure that you will be <br />able to reply to them such this matter can still be heard during the upcoming <br />May 25-26, 1983 meeting. I will plan to present this matter as a "no problem", <br />written presentation to the Board, and you will not: need to be present at <br />the meeting. <br />I will need proof of your publications on the mill area before the Board can <br />consider the application. Please send this as soon as you have it. The other <br />notifications are fine. <br />Your reclamation plan as furnished in the supplement to the Forest Service <br />operating plan appears adequate. The suggested seeding mixture is~acceptable. <br />However, is it to be broadcast or drilled? Also, w;nat grass seed mixture will <br />be planted on the mill/disposal areas? <br />Exhibit H - I have examined your reclamation cost estimate and find some pro- <br />blems with it. First, the costs for the State to tying in the equipment and <br />do this job would be higher than your estimates. Feavy equipment transport <br />costs alone would drive up the cost. Second, you F~ave gi4en no costs for the <br />mill area. I suggest that until you can show that the total reclamation costs <br />to the State would be significantly lower, an adequate financial warranty for <br />all of the disturbances involved would be $1,000.OCi. This is the amount that <br />I propose to recommend to the Board. Please let me know if you have a problem <br />with this figure. <br />I have enclosed a copy of each of the warranty forms necessary for the use of <br />a letter of credit to bond this operation. The fiT•st is the letter of credit <br />itself. The second is the Financial Warranty to go with it. The third is the <br />Performance Warranty that you alone fill out. Do not bother to fill out the <br />legal description for the mine and mill sites on these forms.
