• • -4- . Lessee, and shall pay any increase in property taxes due to the presence or production of minerals from the subject property. It is hereby understood that if any severance or State or County production tax becomes applicable to production from the property then Lessor and Lessee shall bear their pro rata share of any production or severance tax according to their respective distribution of smelter returns, being- 85% Lessee and 15~ Lessor. ARTICLE 10. STATE AND FEDERAL LAWS AND TO HOLD HARMLESS (a) Lessee shall comply with the Workmen's Compensation Laws of Colorado and with FICA withholding requirements, Unemploy- ment Insurance, Occupational Disease and all other state and federal laws and regulations relating to the Lessee's operations and shall save the Lessor harmless from any claims for damages or liability by reason thereof. (b) Lessee will not suffer or permit said premises to be encumbered by any attachments or other lien for labor performed or materials or supplies furnished or used in or thereon, or otherwise, during the term and continuance in force of this lease. (c) Lessor shall post upon the property notices in con- formity with Colorado statute reciting the non-liability of Lessor or the Property from any liability for labor, materials or supplies supplied at the request of the Lessee. (d) The Lessee shall indemnify and save the Lessor harm- less from any suit which may be brought charging air or stream pollution or other environmental damage of any kind resulting from its operation hereunder. Lessee shall supply Lessor with a copy of any and all permits, bonds, prospecting notices or otherwise which it obtains or posts regarding its activities on the Property, Lessee shall supply Lessor with copies of any mining permit or prospecting notice acquired from the Colorado Mined Land Reclamation Board, including evidence of necessary bonding, prior to conducting surface disturbing work on the property. (e) Lessee shall provide Lessor copies of, and shall maintain in effect during the term of this Lease, General Liabil- ity Insurance covering its work on the property.
