Banks and Gesso, LLC <br />Exhibit M -Other Permits and Licenses <br />Additional permits/approvals required for the MMRR Quarry are listed below. <br />Gilpin County Use by Special Review Permit <br />If this property is subject to Gilpin County mining regulations, the applicant will apply for <br />and obtain a Gilpin County Use by Special Review Permit prior to initiating mining <br />activities. <br />CDPS State Discharge Permit <br />Prior to any ground-disturbing activities at the proposed permit area, a <br />CDPSIStormwater Permit will be obtained from the Colorado Department of Public <br />Health and Environment (CDPHE) that will account for any and all off-site discharge and <br />will contain a plan for control of that discharge. <br />Air Permits <br />Prior to any ground-surface disturbing activities (topsoil removal and stockpiling, access <br />road development, haul road construction or material hauling) for the subject property, <br />the Applicant will submit an Air Pollution Emissions Notice (APEN) and obtain a <br />Construction Permit from the CDPHE. This permit will be kept active during the entire <br />life of the mine. The applicant will also obtain permits for any processing equipment <br />(crushers, screens, conveyors) prior to their use. <br />Road Access <br />A CDOT Access Permit has been issued for the subject property for access onto State <br />Highway 119. <br />U.S. Army Corps Of Engineers 404 Permit <br />If required, a 404 Permit from the Corps will be obtained prior to the filling. of unnamed <br />ephemeral drainageways. <br />Colorado Historical Society (CHS) Office of Archeolocty and Historic Preservation <br />Attachment B presents the results of a file search by CHS. None of the sites identified <br />are eligible for the National Register of Historic Sites, nor are they believed to be located <br />within the affected area. <br />Explosives Permits <br />All Federal and State permits for transport, storage and use of explosives will be <br />obtained prior to bringing these materials on site. <br />Clear Creek District Water Providers, LLC October 25, 2004 <br />MMRR Ouarry 28 03047 <br />
