Box 642 <br />Cedazedge, CO 81413-0642 t } 43a~ t~`J-~ <br />970-856-4393 ~ fi`r' ~ "~* ~' Cmeu~u{'y <br />RE.: OfJ~cfathe Benson Brothers' Red Shale Quarry in Coalby Canyon <br />As homeowners living in Coalby Canyon we wish to be made an aggrieved party in the Benson <br />Brother's application for a reclamation permit. <br />Our home is built over one of the major shafts of the now reclaimed Red Canyon Coal Mine. The <br />mine is adjacent to the proposed Benson Brothers' Shale Quarry property and is partially filled with water. <br />_ .Any depletion of the mine's.water could compromise the stability of the mine, damaging our home site. <br />This proposed quarry has the potential of altering the mine's water level if large quantities of water aze <br />taken from the area via wells, etc. This could present a real and potentially monumental hazard to our <br />home, <br />There is a danger that mining procedures, including but not limited to, operation of lazge <br />machinery, on site rock crushing, and heavy truck traffic might cause vibrations, leading to structural <br />failure within the mine, jeopardizing our home. <br />The view ofthe quarry site from ow home is shielded by a few old cedaz and pinion pine trees. If <br />these trees were lost to aging, fue, drought, or insect infestation the quarry would be in full view from our <br />home. <br />Upon retirement we built ow home, knowing we would in time have to move. From the <br />beginning it has been ow expectation to enjoy a rural life style while we can. When health requires we <br />would use the revenue from the sale of ow home to asswe a reasonable level of caze in the futwe. We feel <br />the Benson Brothers' Shale mining operation could put our future security into question by creating an <br />environment that would significantly undermine our property value through aesthetic degradation, the <br />presence of dust and noise, and the potential of structural damage to our home. <br />As homeowners in Coalby Canyon, we wish to state our strenuous objections to the Benson <br />Brothers' Red Shale Quarry operation and request that you deny this permit. We wish to be made a party <br />to the proceedings, we wish to be on the mailing list, and would like for a preheating conference to beheld <br />in Cedazedge. Please have the preheating conference include a tour of the site to which all parties are <br />included.
