<br /> <br />.~a~ ,~ <br />~ G SAND AND GRAVEL LEASE <br />lr (y~ This Gravel Lease is entered into in Gunnison County, Colorado with an <br />effective date of _,~~riy,-n /2 , 1995, as follows: <br />i. PARTIES. The parties to this lease are: <br />GATELY LIVING TRUST, hereafter termed the "Owner", <br />and <br />MELVIN R. GYDESEN and ROBERT GYDESEN, doing business as <br />AMERICAN CONCRETE AND GRAVEL, hereafter termed the "lessee". <br />2. LEASE• The Owner hereby leases to Lessee in accordance with <br />the terms and conditions of this lease, the following described real property situated in <br />Gunnison County, Colorado as set forth on attached Exhibit A. The real property and <br />the access easements as set forth on attached Exhibit A shall be referred to as the "Leased <br />Premises". <br />3. TERM. The term of this Lease shall be: <br />3.1 An initial term of this Lease shall be for a term often years to <br />commence on the date of execution of this Sand and Gravel Lease. <br />3.2 The Lessee shall have the right to renew this Sand and Gravel <br />Lease <br />for and additional term often years so long as there remains unexcavated sand and gravel <br />available for extraction and the Lessee gives notice to Owner to renew the Lease on or <br />before 30 days prior to the termination date of the lease. <br />4. USE OF PREMISES. The Leased Premises shall be used for a sand and <br />gravel operation, the excavation of materials, sand and gravel screening and crashing <br />operations, concrete operations and such other uses and stractures as are reasonably <br />necessary to conduct a sand, gravel and fill material operation and the production of <br />concrete. Top soil is not subject to this Sand and Gravel Lease and shall not be removed <br />from the Leased Premises and shall be stockpiled for reclamation purposes. <br />5. RENTAL PAYMENTS.
