BOX 270 Uinsion Director <br />Yampa, CO 8048? <br />Re: Tellier Gravel Pit, File No. M-98-058, Receipt of 112 Coosttvctioo Materials Reclamation Permit Application <br />Package <br />Dear Mr. Crotfs: <br />On July 8, 1998, the Division of Minerals and Geology received copies of Exhibit Q - Proof of Mailing Notices to the Board of <br />County Commissioners and the Soil Conservarion District, and Exhibit R - Proof of Filing with the County Clerk. The Division must <br />receive the following information before the Division can consider Johnson Excavation, Inc.'s application as being submitted and <br />technical review can begin: <br />EXHIBIT N - Source of legal Rieht to Eeter (Rule 6.4.141: You must provide the source of Johnson Excavation, Inc.'s <br />legal right to enter and initiate a mining operation on the affected land. The submittal of the copy of the Warranty Deed only <br />provides proofthat the land to be mined is owned by Patrick J. Tellier and Edna F. Tellier. You need to submit proof that <br />lohnson Excavation, Inc. has the right to enter the land, that is listed in the legal description, to mine it. A copy of an access <br />lease or a statement by the Landowner and acknowledged by a Notary Public stating that Johnson Excavation, lnc. has legal <br />right of enter and mine the land is acceptable. <br />The application will not be considered submitted until the information listed above is received and found sufficient to begin our <br />review. A decision date will be established 90 days from the date of receipt of all of the requested information. Additionally, you <br />stated in your letter which accompanied Exhibits Q and R that you have already published notice twice, please be aware that once <br />this application is considered submitted you will need to republish the notices once a week for four (4) consecutive weeks, starting <br />within ten (10) days of the date that the application is considered submitted. We will notify you when you should initiate republication <br />of your notice. The final date for receiving comments is the 20th day after the fourth publication or the next regular business day. <br />This letter shall not be construed to mean that there are no other technical deficiencies in your application.
