<br />~~ <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW. AND ORDER <br />IN THE MATTER OF CASTLE CONCRETE COiv1PANY, TABLE MOUNTAIN QUARRY, <br />FILE NO. M-99-004, APPROVAL OF A l 12 PERMIT APPLICATION <br />THIS MATTER having come before the Mined Land Reclamation Board ("the Board") on June <br />22, 1994, for a hearing, the Board makes the following Findings of Fact and Conclusions of Law, <br />and enters the following Order: <br />FINDINGS OF FACT AND CONCLUSIONS OF LAW <br />1. On January 27, 1999, Castle Concrete filed a 1 l2 Permit Application, File No. M- <br />99-004, to conduct a quartzite mining operation in Fremont County, Colorado, Sec. 3, T8S, <br />R66W, 6th P.M. <br />2. Six timely objections to the application were received by the Division of Minerals <br />and Geology ("Division"). As a result, the Division held an Informal Conference on May 13, <br />1999. A[ the informal conference, [he Division discussed the parties and the issues to be <br />considered. <br />3. The matter was scheduled for the June 22-23, 1999, Board hearings. <br />4. On June 24, 1999, the Division issued a recommendation to the Board to approve <br />the permit application. On the same day, the Division mailed its approval recommendation <br />rationale to the parties, addressing the objections and concerns raised during the public comment <br />period and informal conference phases. <br />5. APre-hearing Conference was scheduled to be held in Denver, Colorado, on <br />June 14, 1999. Prior to the Pre-heazing Conference, however, all objecting parties to the <br />application heazing withdrew from party status. As a result, no Pre-hearing Conference was held <br />in this matter. <br />6. The Board held the Final Hearing in this matter on June 22, 1999, in Denver, <br />Colorado. The Division attended as staff to the Board. <br />7. Division staff presented its recommendation for approval [o the Board, along with <br />a recommendation for setting the financial warranty for the operation at $86,742.00. <br />8. As a result of the withdrawal of all objecting parties prior to the Pre-hearing <br />Conference, the Board has the au[hority [o accept the Division's recommendation without a <br />hearing. <br />
