• . <br />• acting under them, where such injury, death or damage occurs because of, or in <br />connection with the use, operation or development in any manner of the leased premises <br />whether such claims are based upon a right conferred by the common law or by statute. <br />Lessee shall apply for all applicaple permits within sixty (60) days of tl~c signing of this <br />Lease. <br />10. Property to be Kept Free t~I,iens. Lessee shall pay and satisfy all claims for <br />materials, supplies, and labor in tonne tton with the working of said mine and mining <br />property, and shall keep the said mine and mining property free of liens or encumbrances <br />of any and every kind, except such as might result from State and County tax <br />assessments not required to be paid by Lessee, or such as may result from the acts of <br />others than Lessee, their employees or those in privity with them. <br />11. Non-Liability Notices. Lessee shall keep posted in conspicuous places about <br />said leased premises where work is being conducted by Lessee, and shall duly record in <br />accordance with the statutes of the State of Colorado, such notices as will inform whom <br />it may concern that said mine and mining property is operated under ]ease and that the <br />Lessor shall not be liable for any of t}~e expenses or charges or operation. <br />12. Taxes. That the Lessee shall pay any and al] taxes and assessments that shall <br />be taxed and levied against the herein described premises and the improvements thereof <br />arising from the activities of the Lessee regazding mining operations on or before the <br />exact date thereof, and Lessee agrees to keep all assessment work done and filed on said <br />premises. <br />13. Protection Against Liens Arising Through Lessor's Default. In the event there <br />aze any liens or encumbrancea against said leased premises, or in the event any liens or <br />encumbrances shall hereafter accrue against the same by acts or neglect of Lessor, then <br />Lessee may, at their option, pay and discharge the same, and if it elects so to do then <br />Lessor agrees to repay Lessee upon demand all such sums so paid by Lessee, together <br />with interest thereon from the date of payment of said sums at the rate of eight percent <br />(8%) per annum until repaid. <br />14. Manner of Giving Notice. Any notice contemplated herein to be served upon <br />Lessor shall be in writing, and shall be sufficiently given if deposited in the U.S. Mail, <br />postage prepaid and registered and/or certified, and addressed to Lessor at his last known <br />address. Any notice herein to be served upon Lessee shall be in writing, and shall be <br />sufficiently given if deposited in the. U.S. Mail, postage prepaid and registered and/or <br />certified, and addressed to Lessee. <br />15. Termination. This Lease shall continue in force and effect for the life of the <br />mine, unless sooner terminated or surrendered as herein provided. <br />This Lease is made upon the condition that Lessee shall perform al] of the <br />covenants and agreements herein set forth to be performed by them, and if there shall be <br />any other default on the pazt of Lessee then and in either of said events the Lessor shall <br />give written notice of default granting Lessee ninety (90) days in which to remedy said <br />default, and if the default is not remedied then the Lease shall terminate and the leased <br />premises shall revert to Lessor, and Lessee shall deliver to Lessor the said premises. <br />16. Lessor's Right to Information. In the event of termination of this Lease for <br />any reason whatsoever, Lessee agrees to furnish Lessor with copies of all drilling and <br />sampling data, reports of tests, a map accurately showing the development work <br />performed by Lessee upon the leased premises and copies of any and all geological maps <br />relating to said leased premises prepazed by Lessee. <br />17. Lessee's Right of Surrender. It is mutually understood anti agreed that Lessee <br />roay at any time surrender and terminate this Lease as to all or any portion of the ]eased <br />premises upon giving to Lessor ninety (90) days notice in writing anti paying to Lessor all <br />royalties and other sums due and payable to Lessor [o file effective date of such <br />surrender. <br />18. Removal of Equipment. Upon termination of this Lease, or furfei[ure, the <br />Lessee shall have the right and privilege of removing all machinery, equipment, supplies, <br />buildings, structures, improvements and personal property placed thereon by the Lessee <br />and such property not removed within ninety (90) days shall be and become the property <br />of the Lessor as a pazt and portion of the mining premises. <br />19. Counterpart. This Lease may be signed in counterpart. <br />-2- <br />
