• EXHIBIT A • <br />LEGAL DESCRIPTION <br />EXIIIBIT "A" eoor.0693PAC-836 <br />All of the West Half (W/2) of Section 36, Township 36 North, Range 14 West, <br />N.M.P.M., lying North of U.S. Highway No. 160 as now constructed. <br />TOGETHER WITH all ditch and ditch rights, water and water rights located thereupon, <br />including the right to use of 90 acre feet of Jackson Reservoir water, together with 1/6 <br />interest in the Boss Ditch, and all interest in 1-3/8 cubic feet of water per second of time in <br />said Boss Ditch under Priority No. 22, Stream Priority No. M 21 taking water from the <br />Rio Mancos, Water District No. 34, per decrees of adjudication dated April 28, 1893 and <br />December 18, 1933, and all interest in 1-1/3 cubic feet of water per second of time in the <br />Sheek Extension of the Sheek Ditch, Priority No. 36, Stream Priority No. 36, taking water <br />from the Rio Mancos, Water District No. 34, per decrees of adjudication dated April 28, <br />1893 and December 18, 1933. <br />FURTHER TOGETHER WITH all of Grantors oil, gas, C02, coal and minerals, if any. <br />SUBJECT TO THE FOLLOWING: <br />Title to all rights to any and all minerals, ores and metals of every kind and character and <br />all coal, asphaltum, oil and other like substances in or under said land and the right of <br />ingress and egress for the purpose of mining, together with enough of the surface of same <br />as maybe necessary for the proper and convenient working of such minerals and <br />substances as reserved to the State of Colorado in Patents recorded in Book 116 at pages <br />387 and 388; and all leases, assignments and easements with respect thereto. <br />Right of way to Highland Utilities Co. as recorded in Book 106 at page 106. <br />Right of way to Montezuma Water Company as recorded in Book 382 at page 23R. <br />Deed to Empire Electric Association, Inc. recorded May 19, 1947 as Reception No. <br />121466. <br />Grantor does not warrant the existence of any right of access to the limited access <br />highway adjoining the subject property.. <br />The above Legal Description includes all property owned by <br />NOLAND, INC. The proposed Gravel Pit description is as <br />follows: <br />Starting at the South West corner of Section 36, Township 36 <br />North, Range 14 West, 561 feet East along the South line of <br />Section 36, thence North Easterly 200 feet paralleling the <br />West boundary of Section 36 to a point of beginning, thence <br />continuing North Easterly 3,120 feet, thence Easterly 858 feet <br />thence South Westerly 3,120 feet to the South East corner, <br />which is 200 feet from the U.S. Highway 160 fence, thence <br />Westerly 858 feet to the point of beginning.
