We anticipate reaching an agreement with Ms. Parker regarding <br />mitigation measures for the Sage Hill Farm wetland, which will negate any impacts to her <br />wetlands and wildlife plantings. Significant berming along the south property line of the <br />Nix property will also help to decrease noise and dust impacts that the operation might <br />have on the wetlands and related habitat. <br />Overall, the operation will not cause a significant decrease in food or habitat for wildlife. <br />Nor will it interfere with migratory routes of wildlife. <br />6.4.12 Exhibit L -Reclamation Costs <br />Per your suggestion, the Applicant would like to utilize the "phased bonding" approach. <br />The figures represented here would be for the largest phase of mining, which will be <br />mining in Area Six. This approach should create a bond amount that would be sufficient <br />to cover the five smaller remaining mine areas. Further, it is our understanding that <br />since mining at 2:1 slopes will leave the desired pit slope for reclamation, no backfilling <br />will be required for reclamation. Therefore, costs for reclamation include equipment <br />mobilization, spreading of topsoil, grading, and revegetation of the site. <br />Equipment Mobilization (Dozer and/or Loader): $194 each x 2 $388 <br />Spreading and Grading of Topsoil (from stockpile): $4.11/CY x 19000 $78090 <br />Revegetation: $47/M.S.F. x 35 $1645 <br />Total $80123 <br />6.4.13 Exhibit M -Other Permits Licenses <br />CDPS Permit. The Applicant has applied for a CDPS discharge permit. The proposed <br />discharge point has been added to the updated Mine Plan Map for your reference. We <br />ask that the Division approve the 112 application with a condition that proof of approval <br />of the CDPS permit be supplied to your office before land disturbance occurs at the site. <br />Substitute Supply Plan. The Applicant has applied for a Substitute Supply Plan through <br />the State Engineer's Office. However, approval for this permit might not occur before <br />the Divisions decision date. We ask that the Division approve the 112 application with a <br />condition that proof of approval of the SSP be supplied to your office before mining <br />below groundwater levels occur at the site. <br />6.4.14 Exhibit N -Legal Right to Enter <br />Since the time of your initial review of the permit, Owens Brothers Concrete Company <br />has since bought the entire property from the Nix's. A copy of the new Deed's are <br />enclosed with this correspondence for proof of ownership and should adequately <br />demonstrate that Owens Brothers Concrete has the legal right to enter the subject <br />property for mining purposes. <br />6.4.15 -Owners of Record of Affected Land and Owners of Substance to 8e Mined <br />The issue of proper of legal right to enter documents and new ownership documents is <br />addressed above. <br />
