Your original comment question is in bold and our response is
in regular type. Many responses are contained in the attachments to this letter.
ADEQUACY ITEMS
Exhi i A - As per Rule 2.1.2(2) the legal description for the proposed permit area
must be provided to at least the nearest quarter section. Please provide this
information.
Attachment 1 contains the revised legal description. Please note a change in the permit
boundary south of Highway 66 for the haul road corridor. The Colorado Department of
Transportation, in the course of issuing an access permit for Highway 66 at the haul road
intersection, required realignment of the road which made it necessary to include more
land within the permit boundary to the west of where it was shown in the original
submittal. Attachment I also contains a revised Exhibit A map of the revised permit
boundary.
2. Exhibi - As per Rule 2.1.2.(4) (b) and (g) please provide a list of all permanent
and man-made structures on the affected area and within 200' of the boundary of
the affected area and label them all on the Exhibit C-1 Map (This includes within
200 feet of the haul road). The Division will require a copy of a letter from the
operator to the owner of each of these structures which stipulates who is responsible
for repair of any damage incurred to the permanent or man-made structure as a
result of the mining operation.
AG RA
Earth & Environments/Group
