Division and the Clerk and Recorders Office. <br />~'•' Article 3-101(5) of the Boulder County Zoning Resolution provides that subsurface <br /> mining is a use by right in the Forestry Zoning District provided odors, dust, <br />~. <br />noise and fluids <br />are confined to the premises. Other accessory u <br />ses, such as the <br /> proposed 4" crus her and explosive storage building are construed to be also a use <br /> by right. Mr. Covey has been informed of building and grading pe rmit requirements <br /> and he has also been advised that if odors, dust, noise or fluid: complaints would <br />fi~. be generated by his allowing the operation to exceed the property lines, it would <br />~`''., become a zoning violation. <br />In several phone conversations with Mr. Covey, he has explained that the mining <br />operation is a hobby due to potential resources and his retirement. He stated <br />that the operation would, at best, be a one truck/week operation hauling the ore <br />to be processed and that a portable 4" crusher would be used on-site for smaller <br />ore samples. The operation would be a daylight (8-5) type of activity and he <br />felt that it would take approximately 2 years to prepare the site for mining. <br />- He has obtained his explosive permit from the Department of Labor and noted that <br />he will not be using dynamite but a fertilizer explosive that is only dangerous <br />when mixed ~eith kerosene. Two storage areas, one for the fertilizer explosive and <br />one for the electric detonators, will be on-site. Each structure will be about <br />6X6 (36 square feet). <br /> <br />MLRC has re~~eived numerous letters of complaint regarding the proposed mine and <br />- has subsequently referred those matters back to the writer stating that their <br />concerns of "noise, truck traffic, and aesthetics do not fall under their jurisdiction <br />and are matters of local zoning concern." <br />An informational hearing on this subject is scheduled for 4:00 P.M., September 27, . <br />~. 1988, BOCC )tearing Room. <br />Additional information, copies of complaints letters and a copy of the ming plan <br />are do file with the Covey File. <br />Josephine W.
