<br /> <br />S) Mining Operations. Reference Exhibit C (e.g., sheet'/, MINING. EXCAVATION AND LAND <br />LEVELING OPERATIONS, Section 4, paragraph 6), revise to specify portable processing operations. <br />This is already explicitly stated in Exhibit D, page 1, in which the processing mechanism is described <br />as a portable plan[. <br />6) Onsite Storage. Reference Exhibit C (e.g., sheet'/+, MINING, EXCAVATION AND LAND LEVELING <br />OPERATIONS. Section 4, paragraph 7), stipulate that no storage of any fuels or otherlm,ardous <br />materials onsite is planned per Mr. Phillips (Rule 3.1.7.(6)(b)(ii)(B)). <br />Again, it is assuma:d in the absence of any statement to [he contrary that no such materials will be <br />stored onsite; however, the Division is requesting that this be clarified. <br />7) Improved Mitigation. Require that complete climate information be provided, specifically as it relates to <br />seasonal wind direction and velocity (Rule 6.4.1 I). Many of the following suggestions arose out of a June <br />26, 2000 meeting among interested parties and various representatives of interested county and state <br />agencies. Require anemometer to monitor wind force & speed, noearth-moving operations when wind <br />exceeds 30 mph. (Reference Lynn Robbio Wagner/Tri-County Health). <br />There are no DM(i Regulations which specifically require these measures. Their inclusion in the <br />Reclamation Plan is left to the discretion of the Applicant. <br />Establish a living snow/wind fence. Awell-established fence will mitigate the impact of visual blight, <br />noise and highly erosive winter winds; aid in containment of fugitive particulate; stabilize the buffer zone <br />to mitigate water erosion of mined/reclaimed areas; and provide a natural screen to mitigate mine impact <br />on area wildlife (Reference Lynn Robbio Wagner, Robert Zebroski, and Daniel Parker.) <br />There are no DMC; Regulations which specifically requires these measures, as well. Their inclusion in <br />the Reclamation Plan is again, left to the discretion of the Applicant. <br />8) Concurrent Reclamation. Although implied in the application and discussed in the Arapahoe County <br />meeting of 6-26-00, nt:ed language in Exhibits C (e.g., Sheet r/a, MINING, EXCAVATION AND LAND <br />LEVELING OPERATIONS, Section 4, paragraph 9), D and E that concurrent reclamation will be <br />employed and that mute site will be regraded to historic contours. Limit the maximum acreage requiring <br />reclamation at any one time to 24 acres. This would ensure concurrent reclamation and minimize topsoil <br />loss due to erosion, soil-moisture loss due to exposure, topsoil degradation due to stockpiling, and the <br />costs of stabilization (.Rule 3.1.5(1), (2), (3) and (5), 3.1.6(3), 3.19(1) and (3), and 6.4.4(2)(e}). <br />The question regarding final contouring of the site is addressed in the Division's comments above, in <br />Concern #3. The maximum acreage to be disturbed at any one time is left to the discretion of [he <br />Applicant as long as sufficient Financial Warranty for the amount disturbed is posted with the <br />Division, in accon~ance with Rules 4.1(4) and 6.4.3(d) of the Construction Materials Rules and <br />Regulations. <br />[mplement immediate soil stabilization for topsoil to be stockpiled more than one growing season; e.g., <br />plant with perennial gt~ass cover (Rule 3.1.9(3)). <br />The question of topsoil storage and stabilization at the site is addressed in the Division's comments <br />above, in Concem #I. <br />
