Responses are listed in <br />the same order as your letter. If specific exhibits have been edited in response to your <br />comments, it is noted. <br />Rule 6.4.4 Exhibit D -Mining Plan <br />1. The applicant understands that the Brownwood Permit M-1979-059 will require a <br />technical revision prior to using the low water crossing. <br />2. The mine plan has been edited to include a seed mix for the topsoil stockpiles <br />3. The overflow pipes are subject to the NPDES permit for the site. The pipes will <br />cross the topsoil stockpiles for Cells A & B. Rigid pipe will be placed just below <br />ground in this area prior to topsoil stockpiling. By the time the pond for Cell D is <br />operated, the haul road (accessing Cells A & B) in this area will no longer be <br />needed. <br />Rule 6.4.7 Exhibit G -Water Information <br />4. The correct Lease has been included between the City of Loveland and Coulson <br />Excavating Co., Inc. <br />5. Water rights associated with the groundwater seeps are owned by the applicant's <br />Lessor, McW hinney Enterprises. A copy of the water right was submitted with the <br />previous adequacy review response submittal in Attachment G-1. The flow rate <br />for the seep north of Cells C&D is calculated to be approximately 0.1 cfs, which <br />corresponds to one of the 4 seeps identified in the Osborn Irrigation System <br />water right. <br />6. For the purpose of mitigating river bank stability assuming a 100 yr flood event <br />were to occur, the pit boundary in the south west corner of Cell D has been <br />moved 40 ft north of the floodplain boundary, In all cases, the pit boundary is <br />above the 100.year flood water surface elevation.
