(3) If, during the course of mining operations anywhere within the permit area,
azchaeological or historic resources are exposed or encountered, Mueller will notify the surface
owner in a timely manner and will cease mining operations to allow the surface owner, in a
timely and prudent manner, to take whatever action is necessary and/or justified to record said
resources with theColorado Historic Preservation Officer and recover them.
Conditioned on strict adherence to each of the foregoing conditions and stipulations as
incorporated into this Order, Ferd Mueller's Application fora 112 construction materials permit
for removal of rock and stone from the azea designated as the Siloam Stone, Inc. Bedrock Mine
