Section 816-117(c) -continued <br />• (i) the woody plants established on the revegetated site are equal to or greater than 90 percent <br />of the stocking of live woody plants of the same life form of the approved reference areas with 80 <br />percent statistical confidence, and <br />(ii) the groundcover on the revegetated area satisfies Section 816.116(b)(3)(iv). Species <br />diversity, seasonal variety, and regenerative capacity of [he vegetation of the revegetated area <br />shall be evaluated on the basis of the results which could reasonably be expected using the <br />revegetation methods described in the mining and reclamation plan. <br />Premining (see Section 779.22) land uses within the permit area can be classified as <br />cropland, pastureland, and rangeland according to the land use definitions contained in 30 <br />CFR 701. 5. Forestry lands as defined in 30 CFR 701.5 are lands "used or managed for <br />the long-term production of wood, wood fiber, or wood products". The premining land <br />uses do not qualify as forestry lands. The reforestation requirements contained in this <br />Section therefore do not apply. <br />Section 816.131 Cessation of Operations: Temporary <br />(a) Each person who conducts surface mining activities shall effectively secure surface <br />facilities in areas which there are no current operations but in which operations are to be resumed <br />under an approved permit. Temporary abandonment shall not relieve a person of their obligation <br />• to comply with atty provisions of the approved permit. <br />Because of existing contractual demands, Energy Fuels does not anticipate any temporary <br />cessation of operations. Ho+vever, in the event of a temporary shutdown, surface facilities, <br />including equipment and storage facilities, will be secured to insure against Hazard to the <br />public health and safety and to the environment. <br />PR-03 816- 165 Revised 7/ 10192 <br />
