Section 816.102 (b) Continued. <br />• only when approved by the regulatory authority. <br />As stated in response to 30 CFR 816.102 (a), the restoration <br />of an undulating topography approximating premining grades <br />makes the use of cut and fill terraces unnecessary. <br />(c) Sma11 depressions may be constructed, if they-- <br />(1) Are approved by the regulatory authority to minimize erosion, <br />conserve soil moisture, or promote vegetation; <br />(2) Do not restrict normal access; and <br />(3) Are not inappropriate substitutes for lower grades on the reclaimed <br />lands. <br />• As stated in response to 30 CFR 816.102 (a), the final topography <br />will consist of simple undulation so that no small depressions <br />will exist. <br />(d) All surface mining activities on slopes above 20 degrees, or on <br />lesser slopes that the regulatory authority defines as steep slopes <br />shall meet the provisions of 30 CFP.
