Adequacy Letter, Roaring Fork Resources, tLlanun Creek Application,,~V ~~'7-s''aDB~13~ <br />~__ ~ <br />Dear Mr. Balaz: <br />In previous correspondence, the Division of Minerals and Geology (or DMG) provided you with two <br />adequacy review documonts, concerning Hydrologic Issues and Geomorphic Stability Issues, for the <br />above-referenced application. <br />Issues that were not addressed included wildlife, threatened and endangered species and the heron <br />rookery located within the proposed permit boundaries. <br />The Division faxed you a copy of the November 5, 2000 Division of Wildlife (DOW) comments on <br />this application. We consider these comments to be an appropriate adequacy review for the wildlife <br />issues. In this letter, it was suggested that the renewable resources area could be downsized allowing <br />a greater buffer between the disturbance area and the heron nesting area. <br />The DMG suggests that limiting the time of disturbance in this area, to avoid activities during the <br />time that the nesting birds are using the rookery, could be an alternative to a larger buffer area. <br />Please respond to the DOW's comments and our suggestion about seasonal time limits in this area. <br />It is the Division's understanding that you will meet with the U. S. Fish and Wildlife Service <br />(USF&W), to discuss the threatened and endangered species situation at the proposed operation, and <br />that the Division of Minerals and Geology might attend this meeting. The Division requests [ha[ you <br />commit to notifying us of any requirements from the USF&W, because such requirements may <br />affect the mine or reclamation plan, permit requirements or the financial warranty requirements. <br />The Division requests that you submit your adequacy review responses by December 22, 2000. This <br />will give the City of Rifle, which has requested "party status" as a formal objector, some time to <br />review your information prior to the Informal Conference meeting. At this time, the Division <br />tentatively plans to hold this conference in Rifle on January 4 or 5, 2001. <br />In order for this application to be heard at the January 24-25, 20001 Board Meeting, the Division <br />must make its recommendation to the Board by January 8, 200E If the recommendation is made on <br />that date, the Pre-hearing Conference will be held on January 16, 2001. <br />
