• disturbance is related to associated construction activities for a diversion ditch on the southern
border of the permit area, and does not affect the actual stream channel. The request for a
variance is founded on Peabody's (now W FC's) commitment to protect the hydrologic balance by
minimizing and mitigating the disturbance using the engineering design and mining and reclamation
plans referenced on the above pages in Attachment 2.05.6(3)(b)(v) (formerly Peabody Tab 16).
Toward this end, WFC will stake the buffer zone and disturbance limits along Calamity Draw to
assure adherence to the approved limits of disturbance.
Any range or coal fires will be controlled or suppressed, and their prevention will be encouraged
to the extent possible. Excluded are those fires approved by the CDMG as part of a management
plan.
The majority of traffic will be in the active pit, spoil, and facilities areas. Other roads will be light
duty roads with a minimal impact to wildlife. The replaced east-west county road will be replaced
to its present location with the right-of-way fenced after the road is reopened.
•
•
(Revised March 2006) 2.05.6(2)-7
